THE GIVEAWAY
"1 week-end in Brussels "

L'IMPERTINENTE, a simplified joint stock company registered with the Paris Trade and Companies Register under number 534 376 041, and headquartered at 71/73 rue de Provence 75009 PARIS - FRANCE (hereinafter referred to as the 'Organising Company'), is organising a game entitled '1 year of Ysé collections' (hereinafter referred to as the 'Game') from 6 to 12 May 2024, which can be accessed on the website www.yse-paris.com.

 

The Organising Company may use the information provided by Participants exclusively.

2.1. Principle

The Contest is open to any natural person of legal age residing in Metropolitan France or Belgium, who holds an email address. However, permanent or occasional members of the Organising Company, its suppliers, and anyone who has had professional contact with the Organising Company for this operation are not eligible to participate (hereinafter referred to as 'Participants').

 

To participate in the Game, visit the website www-yse-paris.com and go to the dedicated Game page.

 

Between 6 and 12 May 2024, Participants will need to provide personal information and answer the question "Choose a departure place."

 

 

By participating, individuals will be automatically entered into a prize draw on 13 May 2024. The winner will win a weekend in Brussels (see details in article 3 below).

 

 

By completing the form, Participants will subscribe to the Ysé Newsletter.



2.2. Conditions for participation and validity

 

Participants can only complete the dedicated page on the site once during the Contest.

 

Registration under a false identity or providing false information, or registering under several identities, will result in disqualification. Additionally, participations to the contest will be cancelled if they are incomplete, erroneous, counterfeit, or made in a way that contravenes these rules.

The draw is scheduled for 13 May 2024.

 

The winner will be notified via email within 5 days and must acknowledge receipt of their prize by replying to the email within the following week. If the winner fails to respond, they may be contacted by telephone.

 

If the participant cannot be contacted within this period and does not reply, they will forfeit their prize. A new participant may be randomly selected.

 

The winner will win a weekend in Brussels:

  • A €500 Ysé gift card, valid for a year, only in our Brussels store
  • 2 nights for 2 people in a hotel (maximum value €400 by person)
  • The journey to Brussels for 2 people (maximum value €300 by person)

The recipient of the prize must communicate the desired weekend and the city of departure via email within 7 days. Failure to do so will result in forfeiture of the prize.

 

The gift card will be sent within 7 days before the desired weekend. It can only be used in the Ysé Brussels store.

 

If the winner is unable to use its €500 gift card in its entirety during the desired weekend, it will be lost.

 

In case of force majeure or if circumstances require it, the Organising Company reserves the right to substitute the prizes won with others of equal nature and value.

 

The winner cannot claim the cash value of the prizes won or request that they be exchanged for other goods or services, except for Ysé dematerialised gift cards. This applies even if the winner decides to refuse the prizes or withdraw from the contest.

 

In this case, the prizes will be forfeited.

The Organising Company will notify the winner via email within 5 days of the draw on 13 May 2024, as well as at each launch of the Collection, allowing them to select their product.

 

The Organising Company cannot be held responsible if the notification to the winner is lost or fails to reach its destination due to circumstances beyond its control, such as a malfunction or a change of contact details.

 

If the winner does not acknowledge receipt of their prize notification or communicate their choice of product within the required timeframe at each deadline, they may be contacted by telephone. If they cannot be reached by any means, they will forfeit their prize.

Participation in this contest implies authorisation for the Organising Company to publish the name of the winner in all present and future media and in any publicity-promotional event related to the contest. This use does not give rise to the right to payment of any compensation other than the prizes provided for.

The Organising Company may process the Participants' names and contact details electronically.

 

In compliance with Regulation (EU) 2016/679, dated 27 April 2016, regarding the protection of personal data, participants have the right to access, rectify, and delete their personal data at any time. They also have the right to object to the processing of their data.

 

To make a request, simply send an email to bonjour@yse-paris.com with your contact details and a copy of your ID.

 

To learn more about how their personal data is processed, participants are encouraged to consult the Privacy Policy on www.yse-paris.com.

The Organising Company cannot be held responsible if a person experiences :

-        any technical failures (such as issues with the line, electrical failures, server incidents, accidental disconnections, etc.)

-        or provides inaccurate or incomplete contact details that prevent them from being informed of their prize.

 

Participation in the game implies that you understand and accept the characteristics and limitations of the technologies used by the internet and those linked to it. This includes technical performance, response times for information retrieval, and the risks associated with connection and transmission. It is important to note that certain data may not be protected against possible misappropriation, and there is a risk of contamination by viruses circulating on the network.

 

Therefore, the Organising Company cannot be held responsible for any content of the services accessed on the Internet, including any information and/or data disseminated on those sites.

Additionally, the Organising Company cannot be held responsible for any issues related to the

transmission and/or reception of data and/or information on the Internet, or any malfunctions of the Internet network that may prevent the proper functioning of the Game.

- The Contest organizers are not responsible for any failure of receiving equipment or communication lines, loss of paper or electronic mail, routing problems, software malfunctions, viruses, computer bugs, anomalies, technical failures, or any damage caused to a Participant's computer or mobile phone.

- Participants are solely responsible for ensuring their system is functioning correctly and for any technical, hardware, or software failures that prevent or limit their participation in the Contest.

 

The Organising Company cannot be held responsible for any direct or indirect damages resulting from the interruption, malfunction, suspension, or termination of the Game, or from a connection to the Internet.

 

All Participants are responsible for safeguarding their data and software stored on their computer equipment against any potential attacks.

 

Any individual who connects to the internet and participates in the Game does so at their own risk.

The Organising Company cannot be held responsible if, due to circumstances beyond their control, the Game is partially or completely altered, delayed or cancelled. No compensation can be requested in such cases.

 

If the proper administrative and technical running of the Game is disrupted by a virus, computer bug, unauthorised human intervention or any other cause beyond the control of the Organising Company, the latter reserves the right to interrupt it.

The competition rules can be obtained free of charge by requesting them from l'Impertinente at 71-73 rue de Provence 75009 PARIS.  Alternatively, they can be viewed on the dedicated competition page on the www.yse-paris.com website.

For the purpose of proof, the Organising Company may utilise any act, fact, or omission, including programmes, data, files, recordings, operations, and other elements (such as monitoring reports or other statements) that are established, received, or kept directly or indirectly by the Organising Company, particularly in its information systems, in connection with the Game.

 

The Participants agree not to challenge the admissibility, validity, or probative value of the aforementioned elements based on any legal provision that requires certain documents to be in writing or signed by the parties to be considered as evidence.

Thus, the considered elements constitute admissible, valid, and enforceable evidence between the parties, with the same evidential value as any document drawn up, received, or kept in writing.

By participating in the Game, you fully accept the terms and conditions outlined in these rules.

The Organising Company reserves the right to cancel, modify, shorten or extend this operation, in whole or in part, if circumstances require it. The Company is not liable to pay any compensation and is not required to justify its decision.

It is agreed that French law shall apply and any disputes shall fall within the jurisdiction of the Courts of Paris. However, if Participants reside abroad, local regulations may apply if they are more favourable.
