GENERAL TERMS AND CONDITIONS
L'Impertinente (Ysé's trade name) is the seller of the products and services on the site.
The e-commerce website www.yse-paris.com (hereinafter referred to as the "Website") is an online retail platform accessible via the Internet network, open to all users of that network.
It is operated by L'Impertinente, a simplified joint-stock company (SAS) with a share capital of EUR 14,180 (hereinafter referred to as "L'Impertinente"), whose registered office is located at 19 rue Bergère, 75009 Paris, France, and which is registered with the Paris Trade and Companies Register under number 534 376 041, with intra-Community VAT number FR17 534 376 041.
The company is managed by Ms Clara Blocman.
The Website enables L'Impertinente to offer its products (hereinafter referred to as the "Products") for sale in France and abroad.
The Website is intended exclusively for individuals and may not be used by professionals.
These General Terms and Conditions of Sale (hereinafter referred to as the "GTCs") govern the use of the Website and the services (hereinafter referred to as the "Services") that may be offered on it, as well as any purchase made through the Website.
Any use of the Website implies the Customer’s full and unconditional acceptance of these GTCs.
This acceptance is necessarily full and entire, any acceptance subject to reservation is considered null and void.
In the event of any amendment to these GTCs, the applicable GTCs shall be those in force on the date on which the Services are used or the order is placed.
These GTCs are available in French.

The essential characteristics of the Products are presented on the Website in each Product sheets.
The customer is herewith informed that the images, photos and colours of the items for sale may not correspond to the actual colours due to effects caused by the Internet browser on the screen used.
The Products offered for sale on the Website are available within the limits of available stocks.
Promotional codes and gift cards cannot be used to purchase gift cards.
If one or more items included in an order are no longer available, the Customer will be informed by email as soon as possible.
The customer may then cancel the order for the affected item or items and, where applicable, receive a refund of any amounts already paid. The refund will be credited to the bank account associated with the payment card used for the purchase no later than 30 days after the cancellation.
The prices of the Products sold on the website are indicated by article and reference and are listed in euros.
The prices of the Products are those displayed on the website, irrespective of the delivery destination, and include all applicable French taxes (VAT included), but exclude delivery charges, which are payable by the Customer (see Article 8 for further information on delivery charges). Any additional local taxes are the responsibility of the Customer.
Please note that customs duties and any taxes that may be payable upon delivery in certain countries to which the Products may be shipped are not necessarily included in the prices and shall therefore be borne by the Customer (see Article 9 for further information regarding customs duties applicable to the return of one or more Products).
Any change in the statutory rate of VAT shall automatically be reflected in the price of the products from the date on which the new rate comes into force.
The applicable prices are the prices displayed on the website at the time of the order.
When ordering, the Customer is required to create an account, enabling them to access their pre-filled information and benefit from promotional offers.
The Customer must therefore complete a personal information form with total honesty and is obliged to update this information whenever necessary.
The Customer must also choose an email address and a password, which will be required each time they wish to access their account.
The Customer's personal information is thus protected by a password so that only the Customer has access to it.
L'Impertinente recommends that the Customer does not disclose their password to anyone.
The Customer must also log out of their account and close their browser window at the end of each session. This will help prevent unauthorised users from accessing the Customer's personal information.
The Customer is solely responsible for maintaining the confidentiality of their password and shall bear sole responsibility for any consequences arising from its fraudulent or unauthorised use.
In accordance with the French Data Protection Act of 6 January 1978, the Customer has the right to access their personal data by submitting a written request to Customer Service at bonjour@yse-paris.com, without prejudice to their right to object, on legitimate grounds, to the processing of such data.
1 - The Customer visits www.yse-paris.com.
2 - The Customer adds the selected items to their shopping basket.
3 - The Customer completes the account creation form.
4 - The Customer reviews the details of their order and identifies and corrects any input errors by means of the order summary displayed before submission.
5 - The Customer reviews and expressly accepts Ysé's General Terms and Conditions of Sale.
6 - The Customer confirms the order, the total price and the final amount payable by clicking "Pay for my order".
7 - The Customer receives an acknowledgement of receipt by email confirming the details of the order. The order shall only be confirmed once the Customer's bank has authorised the payment and L'Impertinente has received the full payment for the order.
8 - The Customer receives an order confirmation by email.
9 - The Customer receives the parcel at the delivery address provided when placing the order.
The order summary will also be available on the Website under the "My Account" section, in the "My Orders" category.
No order shall be deemed accepted until payment has been authorised. Once payment has been accepted, L'Impertinente shall send the Customer an order confirmation by email to the email address provided by the Customer.
The Customer accepts that the invoice shall constitute evidence of the contractual relationship between the parties. The Customer will have the option of printing the invoice sent with the order confirmation.
The Products remain the property of L'Impertinente until full payment has been received for each order.
Payment must be made in a single instalment. However, for purchases of €200 or more, Customers in France may choose to pay in two or three instalments via ALMA.
If the Customer chooses to pay for their order in instalments, they agree to the General Terms and Conditions of ALMA.
The Customer may pay for their order by credit or debit card (Visa, Mastercard, American Express or Bancontact) or, where available, via PayPal (which may be offered for orders outside France). Online payment transactions carried out through our e-commerce website are processed by our payment partner, Mollie, which operates a robust payment security system. Payment transactions made in our retail stores are processed by our payment partner, Adyen.
The Website www.yse-paris.com uses a secure payment system designed to provide the highest possible level of protection for all sensitive data relating to the payment methods used on the Website.
In accordance with Article L132-2 of the French Monetary and Financial Code, any payment commitment made by means of a payment card is irrevocable.
By placing an order on the Website, the Customer warrants that they are duly authorised to use the payment method selected.
L'Impertinente reserves the right to suspend or cancel any order if it encounters any difficulty in obtaining payment.
The Customer may choose to save their payment details in order to facilitate future purchases. Such information will be stored securely by L'Impertinente and will not, under any circumstances, be disclosed to third parties.
L'Impertinente reserves the right to cancel or refuse any order placed by a Customer with whom there is an existing dispute relating to the payment of a previous order.
The resale of any Products purchased through the Website is strictly prohibited.
Furthermore, in order to prevent fraud, L'Impertinente has implemented fraud prevention measures, including the use of exclusion lists, and may take the following actions:
In the event of repeated claims relating to parcels not received or missing items, L'Impertinente reserves the right to open an investigation, including with its delivery carrier. Pending the outcome of such investigation, any refund or replacement shipment may be suspended.
As part of this investigation, L'Impertinente may request additional information from the Customer in order to carry out the necessary enquiries. Any failure by the Customer to cooperate may result in the investigation being closed and the refund request being refused.
Where repeated reports are made, L'Impertinente may also require the Customer to report the matter to the competent authorities. In such circumstances, the Customer will be asked to provide evidence that the report has been made, together with a copy of a valid identity document, so that L'Impertinente may determine the appropriate course of action and provide an appropriate response.
In the event of elements giving rise to a presumption of fraud or proven fraud, L’Impertinente reserves the right to refuse to issue a refund, to cancel current orders, to refuse any new order, and to take any necessary measures, including legal proceedings.
For every order placed through the Website, we undertake to prepare your order within 24 to 96 hours (excluding weekends and public holidays), and within a maximum of 10 working days during periods of high demand (such as Christmas, sales periods, etc.).
When placing an order, the Customer must select one of the delivery methods available on the e-shop:
- Colissimo or Chronopost for deliveries within metropolitan France.
- Global-e's delivery partners for deliveries to the rest of the world.
Delivery charges are calculated according to the delivery address provided by the Customer and vary depending on the geographical destination.
Delivery charges are automatically waived where the order value exceeds the following thresholds:
- Metropolitan France: Standard | €6 and Free from €200 purchase
- European Union countries | From €150
- United Kingdom: Standard | From £100 - Express | From £150
- Switzerland | From 200 CHF
- United States: Free for orders over US$200.
- The rest of the world (including French overseas departments and territories) | From €175.

For customers residing outside the European Union, additional customs duties and import charges relating to the shipment of the order may apply and shall be borne by the Customer.
To request reimbursement of such charges where applicable, the Customer must contact bonjour@yse-paris.com, quoting the order reference and enclosing the relevant invoice.
Delivery Address
The Customer may request delivery of the ordered items to their home, workplace, the address of a third party, their holiday address, or any other address of their choice. The Customer may also request delivery to any individual designated by them.
L'Impertinente shall not be liable for any failure to deliver the ordered item(s) resulting from an error in the delivery details provided by the Customer.
If the Customer is absent at the time of delivery, the carrier will either leave the parcel in the Customer's letterbox, where possible, or leave a delivery notice enabling the Customer to collect the parcel from a post office or collection point within the following days upon presentation of valid identification. Once the parcel has been deposited or made available for collection, the Customer will be notified by email or SMS. The parcel will remain available for collection for up to 10 days.
After this period, the parcel will be returned to L'Impertinente. Customer Service will then contact the Customer to arrange, where applicable, for the parcel to be re-dispatched, the cost of which shall be borne by the Customer. If the Customer does not respond, the order will be refunded.
Once a parcel leaves L'Impertinente's warehouse for delivery to the address specified by the Customer when placing the order, the Customer will receive a dispatch confirmation by email, including the parcel tracking number.
The Customer may track the progress of their order through the secure "My Account" area on the Website or by using the parcel tracking number on the websites provided by La Poste, Colissimo or Chronopost:

Each delivery shall be deemed to have been completed when the Product is made available to the Customer by the carrier, as evidenced by the delivery tracking information available on the websites of the carriers referred to above.
If the Customer has not received any update regarding their order within seven working days of the parcel being dispatched, they should contact the post office nearest to the delivery address.
If neither the post office nor the delivery tracking system available on the websites of the carriers referred to above has any record of the parcel, the Customer must contact L'Impertinente through Customer Service, which will initiate an investigation with the relevant parties.
The time required for our carriers to provide a final response varies between one and three weeks from the date on which L'Impertinente's Customer Service registers the enquiry.
At this stage, the Customer may cancel the order through Customer Service on account of the delivery delay and request a refund. Should the parcel subsequently be located, it will be returned to L'Impertinente.
Alternatively, if the Customer wishes to continue with the order and receive the Product despite the delay:
- If the parcel is located, it will be delivered to the Customer and the normal delivery procedure will resume (delivery of the parcel or notification for collection).
- If the parcel is declared lost (the final response is generally provided within the maximum period of three weeks), L'Impertinente will notify the Customer and will immediately arrange a full refund of the order, including both the Products and the delivery charges.
Events constituting force majeure, which release L'Impertinente from its obligation to deliver, include, without limitation, war, riots, fire, flooding, strikes, accidents and any inability to obtain supplies.
In any event, delivery within the stated timeframes is conditional upon the Customer having complied with all of their obligations.
Upon delivery, it is the Customer's responsibility to inspect the shipment and to make any reservations or claims that appear justified. The Customer should also refuse delivery if the parcel appears to have been opened or shows clear signs of damage.
Any such reservations or claims must be notified to La Poste by registered post with acknowledgement of receipt.
Return Conditions
Any item returned incomplete (product tag, shoulder strap, removable padding, protective hygiene strip, fastenings or buttons), damaged, washed or stained will not be accepted for return. Consequently, no refund will be issued.
Returns from Metropolitan France
The Customer has 15 calendar days from the date of receipt of the order to return an item. A prepaid return label is provided, allowing the Customer to return the order free of charge, provided it was delivered within Metropolitan France. The delivery note must be included in the return parcel. Failure to include the delivery note may result in a delay in processing the return.
Upon receipt of the returned item(s), L'Impertinente will process the return within 3 to 15 working days, and a confirmation email will be sent to the Customer.
Returns from an EU Country
The Customer has 15 calendar days from the date of receipt of the order to return an item.
Returns are either at the Customer's expense or free of charge, depending on the return option selected.
The Customer should retain the tracking number in order to monitor delivery of the return parcel to L'Impertinente's warehouse.
Upon receipt of the returned item(s), L'Impertinente will process the return within 3 to 15 working days, and a confirmation email will be sent to the Customer.
Returns from a Non-EU Country
The Customer has 15 calendar days from the date of receipt of the order to return an item.
Returns are subject to a fixed charge of €14.98 payable by the Customer (Express Prepaid Option).
The Customer should retain the tracking number in order to monitor delivery of the return parcel to L'Impertinente's warehouse.
Upon receipt of the returned item(s), L'Impertinente will process the return within 3 to 15 working days, and a confirmation email will be sent to the Customer.
Returns from Canada
Canadian customers are entitled to a full refund of duties and taxes on returned items, in accordance with the requirements of the Canada Border Services Agency (CBSA).
Returning an Online Purchase to a Store
The Customer may return an item purchased from the Eshop either by post or to any Ysé store. Refunds will only be made to the payment card originally used for the purchase. Returned items must comply with the return conditions set out above. Otherwise, the return may be refused.
Returning an In-Store Purchase to the Eshop/Warehouse
Items purchased in store may only be returned to a store. It is therefore not possible to return an in-store purchase by post. Refunds will only be made to the payment card originally used for the purchase. Returned items must comply with the return conditions set out above. Otherwise, the return may be refused.
Exchanges
L'Impertinente does not offer exchanges for purchases made through the Eshop. Customers are invited to return the item and place a new order instead. Customers may exchange an item in store, subject to stock availability. Simply visit one of our stores and return the item, provided it complies with the return conditions set out above.
Returns of Orders Paid for with a Gift Card
If you paid for your order using a gift card, a new gift card will be issued once your return has been approved by our team. This new gift card may be used on our Eshop and in our stores.
Returns of Orders Paid for with a Discount Voucher
If your order was placed using a discount voucher, the refund will correspond to the net amount paid. The discount will be forfeited and will not be reinstated.
Refund time frame
The Customer's return parcel will be processed within 3 to 15 working days of receipt*. The refund will be credited to the bank account linked to the payment card originally used to pay for the order. The Customer will receive confirmation by email once the return has been processed. From the date of this confirmation email, the refund will appear within 5 to 10 working days.
Where an entire order is returned, the original delivery charges will be refunded to Customers in Metropolitan France.
The refunded amount corresponds to the value of the returned products, provided they are returned with their original tags attached and in perfect condition.
If the Customer benefited from a discount code when placing the order, the discount code will not be reinstated following the return.
If the Customer's return has still not been processed after 3 weeks, the Customer should contact bonjour@yse-paris.com.
*These processing times may be extended during sale periods, new collection launches or other periods of exceptionally high demand.
Faulty Items
Occasionally, an item may have a manufacturing defect or weakness that has gone unnoticed by L'Impertinente. Customers are invited to contact L'Impertinente at bonjour@yse-paris.com and include photographs of the item. The most appropriate solution will then be offered.
Responsibility for Return Parcels
Until L'Impertinente has received the return parcel, it remains the Customer's responsibility. In the event of loss or any other issue arising during transit, the Customer should contact the carrier used for the return shipment. The Customer is also encouraged to inform L'Impertinente by emailing bonjour@yse-paris.com. L'Impertinente cannot confirm receipt of the returned items until the parcel has been delivered. Customers are advised to retain proof of postage until the return has been processed.
Amending or Cancelling a Return Request
Once a return request has been generated, the Customer can no longer add or remove items from the online return request. If the Customer wishes to amend the return, they should indicate the changes on the delivery note enclosed with the parcel and should not include any item they wish to keep. If the Customer no longer wishes to proceed with the return, they should notify L'Impertinente by email at bonjour@yse-paris.com so that the return request can be cancelled.
Refusal of a Return
A Customer's return request may be refused in either of the following circumstances:
-if the return period has expired. In this case, L'Impertinente reserves the right to replace the refund with a store credit voucher equal to the value of the returned items;
-if the returned item does not comply with the return conditions set out above. Every returned product is inspected upon receipt. If the Customer believes that the item is faulty, they should notify L'Impertinente by emailing bonjour@yse-paris.com.
The Products are guaranteed to conform and be free from hidden defects.
Without prejudice to the right of withdrawal provided for in Article 9, if the items delivered do not conform in terms of their nature or quality to the specifications stated on the delivery note, the Customer must inform Customer Service by writing to bonjour@yse-paris.com.
The Customer will then receive a return label by email, which they must print.
The Product must be returned in new condition, in its original packaging and accompanied by the delivery note, to the address indicated on the return label.
If the entire order is returned, the return shipping costs will be refunded to the Customer by crediting the amount due to the Customer’s bank account that was debited for the original transaction.
In view of the increasing number of claims relating to non-delivery, Ysé may review information relating to Customers’ orders, as well as the history of their claims.
In the event of any irregularity or legitimate suspicion of fraudulent behaviour by a Customer (including repeated claims, the use of multiple accounts, falsification of return labels, etc.), Ysé may:
- refuse to issue a refund;
- require the Customer concerned to select a secure delivery method for future orders in order to prevent any disputes. If the Customer refuses to do so, Ysé may decline to process the order;
- in the event of repeated incidents, proven bad faith or fraudulent actions by the Customer, terminate the Customer’s account without further notice, exclude the Customer from the loyalty programme and refuse to accept any future orders.
L'Impertinente shall not be liable in the event that the Website is inaccessible or experiences any access issues, malfunctions or bugs, for any reason whatsoever.
L'Impertinente reserves the right to promote or feature third parties on the Website in any manner whatsoever and shall not be liable for any third-party websites to which visitors may be directed from the Website.
Confidentiality of Personal Data
The personal data collected on the Website www.yse-paris.com is required for the processing of orders.
When an order is placed on the Website by a new Customer, this database is supplemented with information relating to the Customer, enabling L'Impertinente to better meet the Customer’s expectations in the future and to facilitate the support services provided by Customer Service.
In accordance with the French Data Protection Act of 6 January 1978, the Customer has the right to access their personal data, which they may exercise by submitting a written request to Customer Service at bonjour@yse-paris.com, without prejudice to their right to object, on legitimate grounds, to the processing of such data.
Intellectual Property Rights
All Products, as well as the texts, comments, photographs, trademarks, graphics, concepts, illustrations and images comprising the Website, are the exclusive property of L'Impertinente and are protected by intellectual property rights in France and throughout the world.
Any reproduction, whether in whole or in part, of these elements or of the Website is strictly prohibited.
Applicable Law and Jurisdiction
In the event of any translation of the Website and these General Terms and Conditions of Sale, the French language version shall prevail for interpretation purposes.
These General Terms and Conditions of Sale are governed by French law. Any disputes that may arise concerning their validity, interpretation or performance shall fall within the exclusive jurisdiction of the courts of Paris, unless otherwise required by mandatory procedural rules.
If the Customer encounters any difficulties in connection with the ordering or delivery of Ysé Products and considers that their rights as a consumer have not been respected, they may submit a written complaint to bonjour@yse-paris.com in order to seek an amicable resolution of the dispute directly with L'Impertinente.
If the dispute cannot be resolved through the written complaint previously submitted to Customer Service, the Customer has the right, free of charge and within one year from the date of such complaint, to refer the matter to a consumer mediator for the purpose of seeking an amicable resolution of the dispute between the Customer and L'Impertinente.
In accordance with the provisions of the French Consumer Code relating to the "consumer dispute mediation process", the Customer has the right to use, free of charge, the mediation service offered by L'Impertinente.
The consumer law mediator proposed by L'Impertinente is CM2C.

The Customer also has the right to request the resolution of their dispute through the online dispute resolution (ODR) platform made available by the European Commission, provided that they reside in an EU country, Norway, Iceland or Liechtenstein and that the dispute relates to a purchase made online. This ODR platform is accessible via the following electronic address: http://ec.europa.eu/consumers/odr/.
The Customer’s use of mediation is an alternative dispute resolution mechanism and does not constitute a prerequisite for bringing legal proceedings.
