ARTICLE 1. ORGANISATION OF THE GAME

Organising Company: L'IMPERTINENTE, a simplified joint stock company with share capital of €20,041.00, registered with the Paris Trade and Companies Register under number 534376 041, whose registered office is located at 71-73 rue de Provence, 75009 Paris, specialising in retailing clothing in specialised shops under the brand name Ysé (hereinafter "the Organising Company").

Duration: From Monday, Octobre 30th, 2023 to Friday, November 3rd, 2023 at 6:00 p.m (CET). (hereinafter the "Duration").

Purpose: The Rules determine the terms and conditions of the free, no-obligation "Le Grand Soir" Contest, whereby the Organising Company offers to one (1) Participant selected at random (1) €250 Ysé gift card.

There is no obligation to purchase. A purchase will not increase the chances of winning.

These Rules will be available on the website www.yse-paris.com and linked to the form to be completed in order to participate in the Game (see URL below).

2.1. The Contest is open to all residents of metropolitan France, Corsica, French overseas departments and territories and all countries offered for delivery on the Ysé website, who are of legal age on the date of their registration, and who have a valid e-mail address, with the exception of employees and representatives of the Organising Company, its partners, and its subcontractors, as well as their advisors and members of their families (hereinafter the "Participant(s)").

2.2. In order to participate in the Game and have a chance to win the "Prize" (as defined below), Participants must:

A Participant may only register once and the email address entered must be valid. Entries before or after the Duration will not be taken into account.

By taking part in the Game, the Participant accepts these Rules. 

3.1 (1) Participant will be designated as the Winner on Friday, November 3rd, 2023 at 3:00 p.m (CET)., in a random draw conducted by the Organizing Body from among the list of Participants who meet the conditions set forth in section 2.2 herein, 

(hereinafter the "Winner").

3.2. The Winner will be informed by email within five (5) working days of his/her designation. If the Winner: (i) cannot be contacted; (ii) does not respond within seven (7) days of the day on which the Organising Company attempts to contact him/her and/or (iii) refuses the Prize described in article 4, the latter definitively forfeits the rights to win and receive the Prize, and a substitute Winner will be designated, again by drawing lots. After contacting the Winner and verifying that they comply with all the terms and conditions of participation in the Game, in particular by submitting to any additional checks required by the Organising Company, the Winner will be definitively declared the "Winner" of the Game.

4.1 The Prize will be awarded to the Winner, who must be Participant who meet the participation requirements.

4.2 The Prize consists of (1) €250 Ysé gift card.

In the event that the Winner does not use the prize in the required time period, the Prize will be definitively lost, except in the event that the sanitary conditions do not allow them to benefit from it according to the initially planned terms and conditions.

The Prize is personal and is neither exchangeable nor refundable in cash.

The Organising Company reserves the right to replace the Prize with another of equivalent nature and value, without this being able to generate a claim from the Winner.

The Winner will be contacted by telephone or email within five (5) working days of being nominated and will receive confirmation within seven (7) working days of confirmation of their details.

The Prize will be sent by secure mail or email. The Winner must therefore communicate their email and/or postal address to the Organising Company. The Organising Company shall not be held responsible if the address is incorrect.

By accepting the Prize, the Winner authorises the Organising Company to use their name and surname on all known or unknown media, in particular the internet and social networks, without this use giving rise to any consideration other than the Prize won, for the purpose of promoting the results of the Contest.

The Organising Company shall not be held responsible for any delays, losses, damage, Internet or messaging malfunctions that may occur during participation in the Contest.

Participants are formally prohibited from publishing or posting any texts, statements, quotations, photographs, images or, more generally, any content that is obscene, defamatory, in violation of intellectual property rights or any other right of a third party, or legal and regulatory provisions.

The Participants agree to comply with all the conditions of participation in the Game.

The Organising Company shall in no case be liable for any loss or damage resulting from the acceptance of the Prize.

It declines all responsibility for any loss, delay, error, in particular due to a failure of computer equipment, software, Internet browsers, computer networks or Internet connection.

The Organising Company reserves the right, at its sole discretion, to disqualify any Participant who attempts to undermine the running of the Game, in particular by the use of a robot or any automated process.

The Organising Company reserves the right to cancel, suspend or modify the Game in the event that it is impossible to finalise it, due to an event of force majeure, or any bug, virus, intrusion or technical error.

The Game and the Rules are subject to French law. Any dispute shall fall within the jurisdiction of the Paris Courts.

The names and contact details of the Participants may be subject to computer processing by the Organising Company.

In accordance with Regulation (EU) 2016/679 dated 27 April 2016 on the protection of personal data, Participants have the right to access, rectify and delete their personal data at any time, as well as the possibility of objecting to the processing of such data.
